Colorado regulated marijuana businesses need approvals from both the state licensing authority and the applicable local jurisdiction. The state application checklist does not establish one blanket surety bond requirement for every marijuana business license.

Where a bond requirement can arise

A requirement may still come from a local license or permit, construction or right-of-way work, a lease, a utility agreement, a court order, or another contract. The obligee and bond form should be identified in writing before a bond is purchased.

What to collect

Bring the state and local license type, the legal entity name, the property jurisdiction, and the exact document that mentions financial security. Confirm whether it calls for a surety bond, cash deposit, letter of credit, or another option.

Keep licensing and insurance separate

A surety bond does not replace marijuana licensing, property coverage, liability insurance, workers' compensation, product coverage, or other policies that may apply to the operation.

Before you purchase a bond

  • Get the current written requirement or bond form.
  • Confirm the obligee, principal name, amount, term, and filing method.
  • Keep proof that the bond was accepted.
